Abstract
This study aims to examine the urgency of the results of the analysis of children’s psychological tests as a judge’s consideration in deciding children’s hadhonah rights against divorced parents. Where the law should be more concerned with psychological comfort, psychological, place of residence and the environment that affects the growth and development and emotions of children from divorce victims whose custody rights are contested by both parents. From several tests carried out by psychologists on children, the results of the analysis of these psychological tests are used as a reference as evidence that a child is experiencing a traumatic event or not. This research is a normative juridical research, with a statutory and conceptual approach. In this study, the urgency of the results of the analysis of children’s psychological tests as a judge’s consideration in deciding hadhonah rights is described. How does the judge’s decision in handling a child’s hadhonah rights case actually make the child fall to the parent, which is clearly in the results of the analysis of the child’s psychological test that it is medically recorded that the child has a bad picture and trace of the behavior of one of his parents, resulting in the child being reluctant and afraid meet his own parents. The results of this study conclude that there is a need to improve the guidelines for judges’ considerations in deciding hadhonah rights. The results of the analysis of the child’s psychological test should be taken into consideration in deciding hadhonah rights.
