Abstract

Smoking is an activity that has become part of human life in differene parts of the world. There is no one knows smoking. However smoking is a thing that can be said to be relatively new, because cigarettes have not been known at the time of Prophet SAW. Because it is a new one, it’s not suprising it is appears a variety of different opinions in a non legislation, both ulama in person or religious organization which is often used as a reference for the general public Muhammadiyah throught the council of tarjih have established to consider unlawful the smoking, while Nahdatul Ulama established that the smoking law merely improper. The differences of opinion certainly is something to be examined futher. Moreover, both organization are the largest organization in Indonesia and has fanaticism its self. So that whatever be the decicion would have passable As if the law were excavated also by using ijtihad as smoking, that smoking is a new thing and there is no in the period of Rasulullah, thus requariting a new ijtihad to determine its legal, it is not suprising if it appears dissent. Even sometimes these differences into something that never ended . the authors interested in researching more about dissenting opinions, because the difference happens to pay attention to be understood. How between Muhammadiyah and NU previde legal decision cigaretters and whatever the baground in the determination of the smoking law Maker of past time examined using the existing literative is based on legal decision of cigarette and baground issued bay both, then indirectly be known more clearly about what is behind the decision issued by the two organizations. Both organization understand the nash with different view point, so it is not suprising if there is a difference in the determination of smoking law Muhammadiyah to understand nass based on ayat implied that smoking is considered a bad thing and endanger, therefore the cigarettes to consider unlawful. Beside of course based on various studies that claim that cigarettes contain harmful elements that could damage the body and even lead to death. While NU to understand nash to hold on the origin and meaning of what is there, so based on various considerations and because none of nash both in the qur’an and hadith clearly explains smoking law, then the objectionable NU provide not until prohibited
