Abstract
Legal protection for halal products that are not labeled as halal which are consumed by the Muslim community is the basic form of a sovereign state that protects all components of Indonesian society. In Article 29 (1) the State is based on the One Godhead. (2) The State guarantees the freedom of each resident to embrace his or her own religion and to worship according to his religion and belief. Law No. 33 of 2014 concerning Product Guarantee Halal is a special rule regarding halal products on which the Muslim law rests. The theory used is the theory of legal certainty and the theory of maqashid alsyariah, where legal certainty is beneficial to guarantee Muslim consumers that the application of Law No. in masurakat it must be explicitly labeled halal and non-halal products. The protection given to the Muslim community in Indonesia, especially in law number 33 of 2014 there is no rule regarding products that are not labeled halal that may be circulated in the community with the provisions of halal and non-halal information and in addition to providing firmness in the regulations concerning Halal Product Guarantees, whether labeled halal and non-halal labeled. The synergy between Trias politica, namely the Legislature, Executive and Judiciary, in realizing halal product guarantees for Muslim communities in Indonesian jurisdictions, the application of food products consumed by Muslims, must reflect their relationship with Allah Subhana Wa Taala. His every movement, which is in the form of daily shopping is nothing but a manifestation of his remembrance in the name of Allah. Thus, he prefers the path that is limited by Allah by not choosing haram goods, not being miserly, and not greedy so that his life is safe in the afterlife. If a food or drink is clearly halal as stated in the Qur'an, Muslim consumers can calmly consume it ..One of the principles of Islamic law (Qawaidul Fiqhiyah) namely: Idza ijtama'a al-halal wal haramu ghulibal haram (When mixed between halal and haram, then the haram is won) there is a saying that. "You are what you eat."
